1. Acceptance of Terms

By downloading, installing, accessing, or using the Blue Lap mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our App.

These Terms constitute a legally binding agreement between you and Blue Lap ("Company", "we", "us", or "our"). Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms.

2. Description of Service

Blue Lap is a swimming performance analysis and training application that uses artificial intelligence to provide workout recommendations, performance feedback, and training insights. The App integrates with Apple Watch and HealthKit to analyze your swimming data.

Important: Blue Lap is a software tool designed to assist with swim training analysis. It is not a substitute for professional coaching, medical advice, or safety supervision.

3. User Responsibilities and Restrictions

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Be solely responsible for your swimming activities and safety
• Consult with medical professionals before beginning any exercise program
• Not attempt to reverse engineer, decompile, or extract source code from the App
• Not use the App if you have any medical conditions that could be aggravated by swimming
• Not share your account credentials with others

4. Health and Safety Disclaimers

By using Blue Lap, you acknowledge and agree that:

• You participate in swimming activities at your own risk
• Blue Lap cannot and does not guarantee the accuracy of any health or performance metrics
• Results and recommendations are estimates and should not replace professional medical or coaching advice
• You should always swim with proper supervision and safety measures
• You will stop exercising and consult a physician if you experience any adverse symptoms
• Blue Lap is not responsible for any injuries, health complications, or accidents that may occur

5. Limitation of Liability

This includes but is not limited to:

• Personal injury, death, or property damage
• Loss of data, profits, or business opportunities
• Indirect, incidental, consequential, or punitive damages
• Damages resulting from inaccurate metrics or recommendations
• Technical failures, app malfunctions, or data corruption
• Any decisions made based on App recommendations

Your sole remedy for any dispute with Blue Lap is to stop using the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

6. Intellectual Property Rights

Blue Lap and all related content, features, and functionality are owned exclusively by Blue Lap and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes only. You may not:

• Copy, modify, or distribute the App or any part thereof
• Create derivative works based on the App
• Use our AI algorithms, training methods, or proprietary techniques
• Extract or attempt to extract our training data or AI models

7. Data and Privacy

Your privacy is important to us. Our data collection and use practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

By using Blue Lap, you consent to our collection and use of your swimming data for the purpose of providing and improving our services. We may use anonymized, aggregated data to enhance our AI algorithms and training recommendations.

8. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Change pricing, features, or functionality
• Refuse service to anyone for any reason
• Update these Terms at our sole discretion

No guarantee of service availability: We do not guarantee that the App will be available 24/7 or free from interruptions, errors, or technical issues.

9. Indemnification

You agree to indemnify, defend, and hold harmless Blue Lap and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Any injuries or damages you suffer while swimming
• Your violation of any third-party rights

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.

11. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Blue Lap regarding the App.
